Embedded leadership relationships need time to compound — the first 60 days are largely learning your business, your team, and your specific AI context. The 6-month minimum protects both sides: you get past the ramp-up to actual leverage, we get to deliver real value rather than constant onboarding. Two escape valves: (1) 30-day chemistry guarantee — if your assigned lead isn't right after the first 30 days, we reassign or refund. (2) Material breach termination at any time per Terms §14. After 6 months, you can pause with 30 days' notice month-to-month.
Critical question — answered honestly during intake. The Fractional AI CTO is positioned as an AI-specialist peer to your CTO, not a replacement. They own the AI roadmap and AI-specific decisions; your CTO continues to own the broader technology platform. We've seen this go well and we've seen it go badly. It goes well when (a) your CTO openly acknowledges they need AI-specific senior support and (b) the reporting and decision-rights structure is explicit. It goes badly when introduced as a workaround. The intake call surfaces this dynamic so we don't sign something that won't work.
Two options. (1) Tier up — written amendment moves you to the next tier going forward, prorated for the month. (2) Block hours — for surge periods, add hours at $400/hr for the month without committing to a permanent tier change. Most clients land on the right tier within 60 days. We track hours transparently; you see a monthly utilization summary in your status update.
No — they're complementary. The Fractional AI CTO is strategic leadership; Studios build engagements deliver production systems. The same person doesn't typically do both well at scale. Many clients run a Fractional AI CTO retainer concurrent with one or more Studios build engagements — the CTO ensures the builds are sequenced, scoped, and integrated correctly. Operating-tier clients get 15% off concurrent Studios build engagements as a portfolio incentive.
Within reason, yes. "Emergency" means urgent strategic decisions, an AI incident, a critical board meeting moved up — situations where having senior practitioner judgment in the room matters. Same-day Slack response during business hours is the standard. After-hours and weekend responsiveness is tier-dependent — Operating tier includes on-call awareness; Embedded and Advisor are business-hours unless pre-negotiated. We're not a 24/7 SOC; we're strategic leadership.
Standard Studios Confidentiality and IP provisions apply, with one important note for retainer relationships: the Fractional AI CTO is embedded in your leadership and sees more sensitive material than build engagements typically do (board decks, financials, M&A conversations, key personnel matters). We treat all of it as Confidential Information under Terms §10. If you want a separately negotiated NDA layered on top — common for clients with sensitive customer data, IPO prep, or active M&A — we accommodate.
Yes — and this is one of the strongest use cases for Operating tier specifically. Your Fractional AI CTO writes the job spec, defines the technical interview rubric, evaluates final-stage candidates' AI judgment, and supports your permanent hire's first 90 days. About 25% of Operating tier engagements explicitly include "hire my permanent replacement" as a 9-12 month deliverable. We're aligned on this — we'd rather work ourselves out of a job than create a dependency.
30-day chemistry guarantee at engagement start — if your assigned lead isn't right within the first 30 days, we reassign at no cost or refund the first month's fee. After that, standard Studios Terms apply: material breach cure-and-terminate per §14, monthly billing in advance per §6. The 6-month minimum applies after the chemistry guarantee resolves. We do not refund retainer fees for months where services were delivered as agreed, regardless of how outcomes land — strategic leadership is about judgment and effort, not specific guarantees.
